Release of Liability and Assumption of Risk
The individual named below (referred to as “I” or “me”) desires to participate in Kid’s Camp™ by Burn Boot Camp® (the “Activity”) provided by Kids Camp Cornelius, LLC (the “Company”) at 19826 N Cove Rd D, Cornelius, NC 28031 (the “Premises”). In consideration of being permitted by the Company to enter the Premises and participate in the Activity and in recognition of the Company’s reliance hereon, I agree to all terms and conditions set forth in this agreement (this “Release”).
1. Assumption of Risk
I understand that the Activity is potentially dangerous and may involve risks including personal or psychological injury, illness, pain, suffering, temporary or permanent disability, death, property damage, financial loss, and exposure to bacterial or viral diseases.
2. Waiver and Release of Claims
To the fullest extent permitted by law, I waive and release any and all claims against the Company and its officers, directors, managers, employees, agents, affiliates, shareholders, members, successors, and assigns arising out of or related to participation in the Activity or presence on the Premises.
3. Health and Safety Confirmation
I confirm that I am in good health and physically capable of participating in the Activity. I further confirm that I am not currently experiencing symptoms of any communicable disease and agree to comply with all applicable safety protocols and Company instructions.
4. Indemnification
I agree to defend, indemnify, and hold harmless the Company and Releasees from any claims, liabilities, damages, costs, or expenses arising from participation in the Activity.
5. Medical Treatment Authorization
I consent to receive emergency medical treatment if deemed necessary during participation in the Activity and understand that I am solely responsible for related medical expenses.
6. Photo and Video Release
I grant permission for the Company to use photographs and video footage of my image on websites, social media, and promotional materials without compensation.
7. General Terms
This Release represents the entire agreement between the parties and shall be governed by the laws of the State of North Carolina.
